Terms and Conditions

Welcome to The Bodhi Shoppe official website (the “Site”). Please read these Terms of Use carefully before using this Site. Your use of this Site is expressly conditioned upon the acceptance of the following Terms of Use. By using this Site, you agree to these Terms of Use. If you do not agree to any part of these Terms of Use, you should not use this Site. In addition, when using particular features and services on this Site, you will be subject to any posted guidelines and rules applicable to such features and services, all of which are incorporated herein by reference.

Purpose of the Site

The purpose of the Site is to provide you with products and information about The Bodhi Shoppe, sales campaigns and activities we undertake.

Product and Service Availability

Inventory information is generally available on the Site. This information can be used to estimate the likelihood that merchandise will be shipped promptly after you place your order. However, we cannot guarantee that a product listed as “in stock” will actually ship right away, as inventory can change significantly from day to day. In some cases, a product may be in stock when you place your order and sold out by the time your order is processed. However, if an item that is marked “in stock” in your shopping cart when you place your order is sold out at the time your order is processed, we will notify you by e-mail that your order will not be filled and your credit/debit card will not be charged. You may also sign up for our “E-mail Me When Available” service and we will send you an email when your product becomes available. All information provided to us in connection with our “E-mail Me When Available” service is subject to our Privacy Policy.

Refund Policy

We guarantee your satisfaction with all The Bodhi Shoppe merchandise. At this time, we do not offer any refunds or exchanges on our products, except in such cases of incorrect, damaged or defective products.

Orders cannot be canceled or changed once they are placed. Please make sure to check your order before confirming your payment. If you do not want an item after your order has been shipped, you may refuse shipment, when it arrives, to return the items by mail. Refused/returned packages are subject to a $5 restocking fee.

If you receive an incorrect, damaged or defective item, we will promptly send you a replacement or issue you a full refund after you have returned the damaged or defective product. Before we approve any refunds for damaged or defective items, you must contact us via email with proof of the damaged product (broken containers, seriously damaged packaging, etc). If approved for refund/exchange, we will provide you with a printable shipping label, to return the damaged product. You will not be charged any additional shipping or restocking fees for replacement of such shipments.

Exchanges for incorrect or damaged items must be a replacement of the same item. Purchase of additional products must be made as a separate purchase on our site.

If a returned/exchanged product is found to have been used after processing your exchange or return, you will be charged the full applicable price for the returned item, as well as the item for which we provided the exchange and all applicable shipping.

Product Orders

PRICES AND AVAILABILITY OF THE PRODUCTS AND SERVICES LISTED ON THE SITE ARE SUBJECT TO CHANGE WITHOUT NOTICE. The listing, description of, or reference to, a product or service on the Site does not imply that the product or service is presently available or that we endorse that product or service. In the event a product or service is listed at an incorrect price due to a typographical error, error in pricing information received from a supplier, or any other reason, we shall have the right to refuse or cancel any order placed for such product or service at the incorrect price, even if the order has been confirmed and/or your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, we will promptly issue a credit to your credit card account in the amount of the incorrect price.

Product Ingredients & Shelf-life

All of our products are made with all-natural, cruelty-free ingredients that have been selected for their high levels of purity and safety. All products are safe for vegetarians, and used for all skin types, including during pregnancy, unless otherwise indicated on product packaging. Generally, our products have a shelf life of at least two years, when unopened; once a product is opened and used, its shelf life will vary.

In some cases, we may use almond or walnut oil in making our products. While, in most cases, there will be no allergic reaction, please review product details before purchase, to ensure your complete safety in using our products.

Products are to be used as intended in their product details; we are not responsible for any issues caused by improper use.

Sales & Clearance

Special sales & clearance prices for specific products may be subject to change and availability at any time. Special sale items are subject to the terms outlined in our return policy.

Seasonal Products

Typically, Seasonal products are only available during the times specified on our site. In such cases where seasonal products are in high demand, we may consider adding those products to our regular inventory, without notice and price may be subject to change.

Any introductory sales for seasonal products will not be applicable when, and if, those products are added to our regular inventory.

Order Acceptance

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason or for no reason at all. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any product or service.

Shipping & Tracking

We primarily utilize USPS, UPS & FedEx for shipping within the U.S. for fast, affordable and reliable delivery of our products. We will utilize a comparable alternative for prompt shipping outside of the U.S.

We provide standard, ground shipping at a flat rate of $7. Packages can typically be expected within 5-7 business days.

You will receive an email to the address you provided, to track your order with the information provided to us by the shipping company.

Payment

You are responsible for any payments due for any products or services that you order. If we do not receive payment from your credit issuer or its agents, you agree to pay all amounts due to us. You shall also be responsible for any costs of collection of overdue or insufficient payment.

Sales Tax

We are required by law to charge applicable sales tax on products shipped to those jurisdictions that charge such a tax and in which we operate.

Ownership of Materials on the Site

The Bodhi Shoppe is, unless otherwise stated, the owner of all copyright, trademark, patent, database and other proprietary rights on the Site and its contents. Without limitation of the foregoing, we own a copyright on the Site as a collective work and/or compilation, and in the selection, coordination and arrangement of the information and content on the Site. You may not publish, distribute, extract, re-utilize, or reproduce any part of the Site in any material form (including photocopying or storing it in any medium by electronic means) other than in accordance with the limited use license set out in our copyright notice or as permitted by the United States Copyright Act. Except as expressly provided in these Terms of Use and the copyright notice, we grant no rights to you under any patents, copyrights, trademarks, trade secrets or any other proprietary rights.

You may not, without the prior written permission of The Bodhi Shoppe, use any computer code, data mining software, “robot”, “bot”, “spider”, “scraper” or other automatic device, or program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the web pages, data or content found on this Site or accessed through this Site. You also may not: engage in the mass downloading of files from this Site; use the computer processing power of this Site for purposes other than those permitted above; or flood this Site with electronic traffic designed to slow or stop its operation.

User Content

The Bodhi Shoppe may use, display, reproduce, distribute, transmit, combine with other materials, alter and/or edit the User Content for legal and/or regulatory reasons in any way it sees fit (while maintaining the original sentiment), with no obligation to you whatsoever.

You confirm and agree that:

(i) you own all the rights in the User Content and/or that you have permission from any person(s) appearing in the User Content to grant the rights herein (including permissions from parents and/or guardians if the individuals are under the age of 18 years old), and if you are not the holder of such rights, the holder of such rights has completely, competently and effectively waived all such rights and irrevocably granted you the right to grant the licenses stated above without the need for payment to you or any other person or entity;

(ii) you and all other person(s) appearing in the User Content are not under 18; and

(iii) The Bodhi Shoppe’s use of your User Content will not break any law or violate the rights of a third party, including that it will not infringe on the intellectual property, privacy, publicity, statutory, contractual or other rights of any third party. The Bodhi Shoppe has the right to disclose your identity to any third party who claims that the User Content infringes their rights.

You warrant that your User Content is truthful and accurate and that it does not misleadingly exaggerate the effect any The Bodhi Shoppe product(s) are capable of achieving (whether through pre-production techniques or post-production techniques.

You acknowledge and agree that the User Content could be subject to “viral” communication (word-of-mouth communication) on third party websites and that The Bodhi Shoppe will not be liable for any claim or action in this regard.

You consent to The Bodhi Shoppe’s collection of any personal information you provide, and The Bodhi Shoppe’s use and disclosure of that personal information in connection with the use of your User Content as described above. Your personal information may be shared with affiliates or other trusted third parties working on The Bodhi Shoppe’s behalf. By posting User Content with any of The Bodhi Shoppe Hashtags or otherwise providing The Bodhi Shoppe with personal information, you agree to such collection, use, disclosure, transfer and processing of your information in accordance with these Terms and Conditions, The Bodhi Shoppe’s Privacy Policy, and applicable data protection laws and regulations.

You accept that The Bodhi Shoppe will not pay you for the use of your User Content and/or for any intellectual property rights connected with them, and that you have no right to inspect or approve the editorial copy or other material that may be used in connection with your User Content.

You accept that The Bodhi Shoppe may refuse to use or remove your User Content for any reason.

THE BODHI SHOPPPE HAS THE ABSOLUTE RIGHT TO REMOVE AND/OR DELETE WITHOUT NOTICE ANY USER CONTENT WITHIN ITS CONTROL THAT, IN ITS SOLE DISCRETION, IT DEEMS OBJECTIONABLE OR THAT VIOLATES ANY OF THE RESTRICTIONS IDENTIFIED IN THESE TERMS. YOU CONSENT TO SUCH REMOVAL AND/OR DELETION AND WAIVE ANY CLAIM AGAINST THE BODHI SHOPPE FOR SUCH REMOVAL AND/OR DELETION. THE BODHI SHOPPE IS NOT RESPONSIBLE OR LIABLE FOR FAILURE TO STORE POSTED CONTENT OR OTHER MATERIALS YOU TRANSMIT THROUGH THE SITE OR VIA SOCIAL MEDIA. YOU SHOULD TAKE MEASURES TO PRESERVE COPIES OF ANY DATA, MATERIAL, CONTENT OR INFORMATION YOU POST ON THE SITE OR ANY OTHER SITES OR PLATFORMS.

Applicable Law

These Terms of Use are governed by and will be construed in accordance with the laws of the United States and the State of New Jersey. Any disputes arising under or in connection with these Terms of Use or your access or use of the Site shall be subject to the exclusive jurisdiction of the State and federal courts located in the Essex County District of New Jersey.

We may terminate the use privileges of users who are repeat infringers of intellectual property rights.
